Slip and Fall Accidents

Slip and fall accidents in Florida are one of the most difficult cases to handle.   A great burden is placed on the Plaintiff to establish that a dangerous condition existed which the defendant knew or should have known about, who did not take reasonable steps to remedy or fix it, and/or who did not take steps to warn the Plaintiff about the dangerous condition.  It is all the more important to hire a personal injury attorney who handles slip and fall cases to build a proper foundation for your case.  Appropriate defendants, and their carriers, need to be identified and notified in a timely manner.  Requests for the preservation of evidence (ie, the dangerous condition, possible surveillance video, etc) need to be timely made and to the appropriate party.  Additionally, you may find it difficult to obtain medical treatment if you do not have group health coverage.   A personal injury attorney may be able to assist you in getting treatment under what is called a Letter of Protection.

1.  Always look to see what you slipped and fell on.

2.  Take picture and video if you can of the substance/object you fell on.

3.  Note if the substance looked soiled or dirty (it will help establish the length of time the dangerous condition may have been there).

4.  Be sure to take pictures of any lacerations, abrasions, or bruising (as they will heal relatively quickly).

5.  Be sure to seek immediate immediate medical attention for your injuries.

6.  Save your shoes (and clothes if stained) you had on when you fell and store them in a plastic bag or container in case the matter goes to trial.

7.  Do not speak to an insurance company until you speak to an attorney.
